Not every document carries the same legal weight. A formal notice terminating the contract, a payment order and a seizure each have a different effect. But every stage shows that the case is moving forward and that the time to react is shrinking.
Formal notice terminating the contract
A formal notice terminating a loan or credit agreement is usually the creditor's first serious move. With the termination, the debt is presented as overdue and due, and the way is opened for a payment order to be issued. At this stage there may not yet be an objection deadline, but there is time that must not be lost. The case must be reviewed immediately, before the claim becomes a judicial title and before the borrower has to defend under pressure.
Payment order
The payment order is the second and far more serious step. The claim now takes a judicial form and can be used for enforcement. An objection against the payment order is filed within fifteen working days of its service, when the debtor's residence or seat is in Greece. If the residence or seat is abroad or unknown, the deadline is thirty working days. With a payment order, we do not wait. We move immediately.
Seizure
Seizure is the third critical stage. With seizure of real property, the auction is already set, so the case is no longer at a warning level. Enforcement has begun. An objection against enforcement, on grounds concerning the claim, the writ of execution, the preliminary procedure and the seizure itself, is filed within forty-five days from the date of seizure. If a suspension of the auction must also be sought, that step is examined separately and must be taken in time.
The conclusion is simple. With a notice terminating the contract, we do not stay idle. With a payment order, we act without delay. With a seizure, the response must be immediate, because with it the auction is already on the table.

Τελεσίδικη ακύρωση διαταγής πληρωμής – Το Εφετείο έκρινε ότι η απαίτηση δεν είχε νομικό θεμέλιο. Η ενοχή δεν τεκμηριώθηκε, η εκτέλεση σταμάτησε. Το Εφετείο ακύρωσε τελεσίδικα διαταγή πληρωμής, διαπιστώνοντας ότι η απαίτηση δεν τεκμηριώθηκε ούτε ως προς το ύψος, ούτε ως προς τη νομική της βάση. Η κρίση στηρίχθηκε στο άρθρο 174 ΑΚ, αφού δεν υπήρχε σαφής δήλωση βούλησης για τη δημιουργία ενοχής. Η νομιμοποίηση του servicer δεν αρκούσε – το Δικαστήριο ζήτησε ουσία και δεν τη βρήκε. Με την υπ’ αριθμ. 24../2024 απόφαση του Μονομελούς Πρωτοδικείου Αθηνών, ακυρώθηκε η κατάσχεση γιατί δεν αποδείχθηκε ποτέ η νόμιμη ένταξη της απαίτησης στο χαρτοφυλάκιο της Τράπεζας Πειραιώς. Το δάνειο είχε χορηγηθεί από την πρώην Λαϊκή Τράπεζα Κύπρου μέσω ελληνικού υποκαταστήματος, αλλά η Πειραιώς ουδέποτε απέδειξε την ορθή μεταβίβαση. Πολύ δε περισσότερο, δεν αποδείχθηκε η μεταγενέστερη τιτλοποίηση. Το Δικαστήριο επισήμανε την απουσία θεμελιωδών εγγράφων (παραρτήματα σύμβασης, ειδική ταυτοποίηση απαίτησης) και κήρυξε άκυρη την κατάσχεση βάσει του άρθρου 925 ΚΠολΔ. Το λεγόμενο "χαρτοφυλάκιο κυπριακών δανείων" παρουσιάζει συστημικά ελλείμματα τεκμηρίωσης – με τον κατάλληλο χειρισμό, μπορούν να αποδομηθούν πλήρως οι ισχυρισμοί των εταιριών και να ανακοπεί η εκτέλεση.
